DMCA & Content Removal Policy

This Policy forms part of our Terms of Service. It provides four removal tracks: (A) copyright infringement (DMCA), (B) illegal content (including EU DSA notices), (C) appearance without consent / consent withdrawal (persons depicted in content), and (D) other complaints. Anyone — with or without a Platform account — may use these mechanisms, free of charge.

1. Emergency Priority

Reports involving minors or non-consensual intimate material are handled with absolute priority: the reported content is suspended from view immediately upon triage, investigated at once, and — where the report is confirmed — permanently removed, with preservation of evidence and reporting to law enforcement and the National Center for Missing & Exploited Children (NCMEC) where applicable. For non-consensual intimate imagery reported by or on behalf of the person depicted, we remove confirmed material within 48 hours of a valid request. Email complaints@muscleworship.io with subject line "URGENT".

2. Track A — Copyright Infringement (DMCA)

2.1 We respect intellectual property rights and respond to notices that comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. §512) and equivalent laws.

2.2 To file a takedown notice, send to our designated agent (Section 2.5) a communication including:

  1. Identification of the copyrighted work claimed to be infringed (or a representative list);
  2. Identification of the infringing material and its exact location (full URL(s) on the Platform);
  3. Your name, mailing address, telephone number, and email address;
  4. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner, or authorised to act on behalf of the owner, of the exclusive right allegedly infringed;
  6. Your physical or electronic signature.

2.3 On receipt of a valid notice we will remove or disable access to the material expeditiously, notify the uploader with a copy of the notice, and record the notice. Misrepresentation in a notice or counter-notice gives rise to liability under 17 U.S.C. §512(f); abusive or repeated manifestly unfounded notices may result in suspension of processing under Section 6.3.

2.4 Counter-notice. An uploader who believes material was removed by mistake or misidentification may send a counter-notice containing: identification of the removed material and its former location; a statement under penalty of perjury of good-faith belief that removal was a mistake or misidentification; consent to the jurisdiction of the U.S. federal district court for the uploader's address (or, if outside the U.S., [the U.S. District Court for the District of Delaware]) and acceptance of service from the notifier; and a signature. Unless the notifier informs us within 10–14 business days that it has filed a court action, we may restore the material.

2.6 Repeat infringers. We terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

2.7 Creator content piracy. Creators may ask us to issue takedown notices on their behalf against third-party sites republishing their Platform content (Terms of Service, Section 13.4).

3. Track B — Illegal Content Notices (EU DSA and General)

3.1 Anyone may notify us of content they consider illegal (under EU law, the law of an EU Member State, or other applicable law) using the report button on any content or by emailing complaints@muscleworship.io. To enable diligent handling (Article 16, Regulation (EU) 2022/2065), include:

  1. A sufficiently substantiated explanation of why the content is illegal;
  2. The exact electronic location (URL(s)) of the content;
  3. Your name and email address — not required where the report concerns child sexual abuse material or other offences under Directive 2011/93/EU;
  4. A statement confirming your good-faith belief that the information in the notice is accurate and complete.

3.2 We confirm receipt without undue delay, review the notice diligently, objectively, and without discrimination, and notify you of our decision, indicating whether automated means were used. Content that is manifestly illegal is removed immediately upon triage.

3.3 Statement of reasons. Where we remove, restrict, demote, demonetise, or suspend anything, the affected user receives a statement of reasons (facts, ground relied on — legal or contractual, whether automation was used, and redress options), per Article 17 DSA.

3.4 Trusted flaggers designated under Article 22 DSA receive priority processing. Orders from Member State authorities under Articles 9–10 DSA are actioned and confirmed as the DSA requires.

4. Track C — Persons Appearing in Content: Consent Withdrawal and Non-Consensual Appearance

4.1 Anyone who appears in content on the Platform may request its removal, whether or not they have a Platform account and whether or not they previously consented. This track exists in addition to your legal rights and implements card-network requirements for adult platforms.

4.2 Email complaints@muscleworship.io with: your name and contact details; the URL(s) of the content; a statement that you appear in the content; and the basis of your request — (a) you never consented to the recording or its publication, (b) your consent was invalid (given as a minor, under duress, or while incapacitated), or (c) you withdraw your previously given consent. We may take reasonable steps to verify that you are the person depicted (via our verification provider); verification data is used only for this purpose.

4.3 Handling: the reported content is suspended from public view while we investigate. We resolve complaints under this Track within seven (7) business days [DRAFTING NOTE: state five (5) if Segpay is the processor]. Content is permanently removed where consent is absent, invalid, or withdrawn, or where the uploader cannot produce the required consent and identification records (Terms of Service, Section 10). Downloads are disabled for content under review.

4.4 Neutral review. If we determine that valid consent exists and you disagree, the dispute is referred to a neutral third-party dispute resolution organisation at our expense, and we abide by its outcome. Details of the body and process are provided in the decision notice.

5. Track D — Other Complaints

Defamation, privacy, trademark, harassment, impersonation, and other complaints may be sent to complaints@muscleworship.io with the URL(s) and an explanation. We review under the Terms of Service (including the Acceptable Use rules) and applicable law, and respond with our decision and available redress.

6. Appeals, Abuse, and Transparency

6.1 Internal appeals. Uploaders whose content was actioned, and notifiers whose reports were rejected, may appeal free of charge through the internal complaint-handling system for six (6) months from the decision (Article 20 DSA; Terms of Service, Section 12.4). Appeals are reviewed by qualified staff and not decided solely by automated means.

6.2 Out-of-court options. EU users may refer eligible disputes to a certified out-of-court dispute settlement body (Article 21 DSA). Consumers may use the ADR routes in Section 20.3 of the Terms of Service. Nothing here limits access to courts.

6.3 Abusive notices. We suspend, after warning, the processing of notices and complaints from persons who frequently submit manifestly unfounded ones, weighing the factors in Article 23 DSA.

6.4 Records and reporting. We log all notices, complaints, decisions, and turnaround times; report moderation statistics in our transparency reports; and provide our payment partners the reporting required by card-network rules (including monthly reporting of flagged content and takedown requests).
