1. Platform Status Under 18 U.S.C. §2257

muscleworship.io (the "Website") is operated by [MUSCLE WORSHIP OÜ] (the "Operator"). The Operator is not the "producer" — whether primary or secondary — of any depictions of actual or simulated sexually explicit conduct that appear on the Website, within the meaning of 18 U.S.C. §§2257 and 2257A and 28 C.F.R. Part 75. Pursuant to 18 U.S.C. §2257(h)(2)(B)(v) and 28 C.F.R. §75.1(c)(4), the Operator's activities with respect to such content are limited to the transmission, storage, retrieval, hosting, and/or formatting of depictions posted by third-party users (Creators), on areas of the Website under the relevant user's control.

2. Creators Are the Producers and Record-Keepers

Each Creator who uploads content to the Website is the producer of that content and is contractually required, as a condition of using the Website, to:

  1. be at least eighteen (18) years of age, verified by government-issued photo identification and liveness checks through the Operator's third-party verification provider before any content may be published;
  2. verify the age and identity of every person appearing in any content they upload, by examination of government-issued photo identification, and to retain copies of that identification;
  3. obtain and retain the signed, written, express, prior, and fully informed consent of every person appearing, covering their depiction, its distribution on the Website, and whether it may be downloaded;
  4. maintain the records required by 18 U.S.C. §§2257 and 2257A and 28 C.F.R. Part 75 for all content they produce, and act as custodian of those records; and
  5. produce such records to the Operator within 48 hours of request, and make them available to authorities as the law requires.

The Operator reviews all content prior to publication and removes content for which required verification or consent documentation is missing or not produced on request.

3. Voluntary Compliance

Although the Operator is not established in the United States and is not the producer of user-uploaded content, the Operator voluntarily maintains the compliance program described above and requires all persons depicted in any sexually explicit content on the Website to have been at least eighteen (18) years of age at the time of production.

4. Operator-Produced Content

With respect to any depictions of actual or simulated sexually explicit conduct produced by the Operator itself (if any), the records required by 18 U.S.C. §§2257, 2257A and 28 C.F.R. Part 75 are kept by the following Custodian of Records:

5. Exempt Content

Certain content on the Website may include depictions that are exempt from the record-keeping requirements of 18 U.S.C. §2257 because it does not portray conduct specifically listed in 18 U.S.C. §2256(2)(A)(i)–(iv), was produced before July 3, 1995, or otherwise falls outside the statute. Such exemption does not affect the Operator's contractual verification and consent requirements above, which apply to all content in which any person appears.
